Rental terms.

AS Premium Rent-a-Car provides the car for use for the period and under the conditions set out in the rental agreement.

By signing the agreement, the renter confirms that the car was received in good working order.

The renter agrees to pay for the fuel used during the rental.

The renter agrees to return the car with all tyres, tools, documents and the standard and additional equipment with which it was received.

The renter will return the car on the agreed date, or earlier at the request of AS Premium Rent-a-Car. To extend the rental, the renter must request the consent of AS Premium Rent-a-Car at least 24 hours in advance and pay an additional deposit at the same time.

The car may only be driven by the renter or a person named in the agreement as a second driver, provided they have all the required qualifications and documents.

The car must not be used:

• for the paid transport of goods or passengers
• for towing other vehicles
• for motor sport competitions
• if the renter is under the influence of alcohol and/or narcotics
• if it is overloaded, i.e. carrying more passengers than the law allows for that type of vehicle
• to carry animals, flammable or explosive materials, materials with a strong or unpleasant smell, or bulky materials that may damage the car

The renter may not transfer their rights under the agreement, nor sell (dispose of) the car or any of its parts.

If the renter exceeds the agreed return date without the prior consent of AS Premium Rent-a-Car, the car will be considered stolen and AS Premium Rent-a-Car will notify the police. In that case the renter bears full material and moral responsibility.

During the rental, the renter agrees to look after the technical condition of the car, regularly check the coolant, oil and tyre pressure, and carry out necessary oil changes. These costs may be reimbursed with the prior consent of AS Premium Rent-a-Car and upon presentation of receipts. The renter is liable for all damage caused by improper maintenance.

The renter is liable for damage to the car caused by improper use (driving off-road and similar), regardless of whether the excess waiver was purchased. The renter will be charged for towing, loss of value and loss of income during repairs. The renter also bears any costs AS Premium Rent-a-Car may incur towards third parties as a result of improper use of the car.

The renter is liable for damage to the car during the rental caused by the renter or a third party if the renter provided false information about themselves, their address or their driving documents.

When not using the car, the renter must lock it and take the keys and the car documents with them. At the end of the rental the renter must return the keys and documents or compensate for their loss.

The renter releases AS Premium Rent-a-Car from all liability for theft, damage or loss of property left in the car during the rental and after the car is returned, and agrees not to hold AS Premium Rent-a-Car liable for theft or loss of property.

The renter will not bear the cost of mechanical failures if they took measures to prevent such failures.

During the rental, the renter bears the costs of garaging, parking, traffic fines and other non-standard costs.

AS Premium Rent-a-Car bears no responsibility for consequences caused by a breakdown of the car during the rental.

If the seals are damaged, or the odometer or the car breaks down, the renter must stop driving and notify AS Premium Rent-a-Car, who will give instructions on how to proceed.

The renter agrees to pay all costs under this agreement within the legally prescribed period.

The car is covered by comprehensive (casco) and third-party liability insurance.

In the event of a traffic accident, the renter agrees to protect the interests of AS Premium Rent-a-Car by:

• recording the names and addresses of those involved and of witnesses
• securing the car or moving it to a safe place before leaving it
• notifying AS Premium Rent-a-Car of the accident and submitting a written damage report
• calling the police and waiting for their inspection

If the renter fails to take these measures, they are liable for all consequences and damage that AS Premium Rent-a-Car may suffer as a result.

Damage to the car of up to 1,000 KM is borne by the renter.

Changes to the terms and provisions of the agreement are only possible with the written consent of both parties.

In the event of a dispute under this agreement, the Municipal Court in Ljubuški has jurisdiction.
